Citing laxity, HC asks I-T to return jewellery seized in 2002, refund tax plus interest | Mumbai News

MUMBAI: The Bombay high court directed the income-tax department to return jewellery seized 21 years ago from a businessman in Pune and refund with additional interest Rs 7 lakh paid as tax over its inaction in the case despite an ITAT order as well as follow up by the family.
I-T had searched Lakhpatrai Agarwal’s house in August 2002 and seized the jewellery after he admitted undisclosed income of Rs 28 lakh. In 2010, the Pune Income Tax Appellate Tribunal (ITAT) directed fresh assessment. After Agarwal died of old age, his legal heir wrote to I-T in March 2018, seeking refund and the return of jewellery as the department had failed to complete the fresh assessment. In July 2022, I-T sent Sunil Agarwal, the heir, a notice about starting the fresh assessment in August. At this, Agarwal moved the high court with his lawyer Sham Walve saying such belated action was time-barred. He pointed at section 153(3) of the I-T Act and said a fresh assessment has to be completed within nine months from the end of the financial year in which the order is received by the commissioner.
I-T, represented by advocate Ajeet Manwani, said it did not receive the 2010 ITAT order and the compliance period does not begin till the order “is received” as mentioned in the I-T Act.
The high court held that a period for receiving the order has to be “reasonable’’. “We are unable to accede to the contention of the (I-T office) to construe the words ‘is received’ in section 153(3) to mean ‘till it is received’ and thereby extend the limitation in perpetuity. It has to be a reasonable period of time, especially when the respondents (Union ministry of finance and income-tax commissioners) are a party to the proceeding,” said a

It’s seller beware when it comes to old gold and jewellery – Kelowna News

Inflation and high interest rates have people looking for money in different ways.

According to Premier Jewellery and Loans in Kelowna, more people seem to be rummaging through old jewellery boxes and stopping by the shop to help make ends meet.

“We have definitely seen a large increase in clients coming in. It could be post Christmas, it could be the effects of inflation or possibly a recession coming. But we have definitely seen an increase,” said owner Martin Strasser.

“You have gold, diamonds or watches sitting in a box and now you have a bill that’s due or inflation is hitting you. Your money doesn’t go as far as it used to, so you want to find a way to stretch those dollars.”

Premier Jewellery and Loans loaned Castanet two pieces of jewellery and a gold coin to help in a market assessment of local and pop-up jewellery buyers.

Premier provided a 9.61 gram 10K yellow gold ring, an older style engagement ring with 18K gold and 0.42 carat diamonds and a one ounce Canadian gold coin .

Castanet took the same two rings and the gold coin and had them appraised at Canadian Jewellery Exchange in Kelowna and GLK Gold, a pop-up buyer that visited the city last weekend.

Premier was the only shop aware Castanet was running the story at the time appraisal.

Jewellery Exchange offered a comparative appraisal to Premier and was open about the engagement ring‘s potential lack of movement in consignment.

Jewellery Exchange appraiser Mark Schlitt said in an interview afterwards every shop has different interests.

Looking at this, a fan reminded her how Varun had also given her his jersey on Ace Of Space. But Divya told him, “That jersey was just on the show… he took it back just after we came out of the house 😂”

It’s a sell-out: Industry mood positive ahead of Australian Jewellery Fair


For the second consecutive year the Australian Jewellery Fair (AJF) has sold out far in advance of opening day.

The AJF will be hosted at the International Convention Centre in Sydney’s Darling Harbour on 18-19 March.

The AJF has been timed to take place prior to Mother’s Day (14 May), giving retailers the opportunity to stock the latest ranges ahead of a crucial period of trading.

Three major buying groups – Nationwide Jewellers, Independent Jewellers Collective, and Leading Edge Jewellers – will each host stands after a productive Melbourne Jewellery Expo, which was also a sell-out event. The GAA will also be at the event.

Expertise Events managing director Gary Fitz-Roy told Jeweller that the most valuable thing available at the AJF for suppliers and retailers alike would be ‘opportunity’.

“We are thrilled to see such a high level of interest in the Australian Jewellery Fair this year. We’ve been anticipating a high turnout, but didn’t expect it would sell out so quickly,” Fitz-Roy said.

“We are confident that the fair will provide a valuable opportunity for retailers and sellers to discover new ranges, to build connections, and to reconnect within the industry.”

Fitz-Roy explained that a new initiative had been introduced for AJF: “The fair will also feature free all-day catering, so retailers and sellers can maximise their time and enjoy a free lunch. This is just one of the ways we are working to make the fair an enjoyable and productive experience for everyone involved”.
